SPECIFICS OF BLOCKCHAIN-RECORDED DATA

Before you register Your Personal Account in the Wallet, access and use the Wallet, and/or submit any of Your Personal Data to or with help of the Wallet You need to understand and accept the risks generally associated with the specifics of data recording on Blockchains supported by the Wallet, discussed in this Section. A decentralized Blockchain, such as Ethereum, may be distributed all over the world, across multiple nodes, which means that (i) there is no single decision-maker, validator or a centralized administrator of the system, and (ii) there is no centralized data storage and data is distributed throughout the Blockchain. Please be aware that the Wallet architecture utilizes Blockchain technology. Accordingly, Your Personal Account cannot be created without creating corresponding records on the Blockchain. Registration of Your Personal Account entails generation of the following key elements enabling You to use the Wallet: Your Personal Wallet Address, Your Private Key and Your Public Key. This data is created and stored on the Blockchain. In addition, data on any and all Transactions incoming to and outgoing from Your Personal Wallet Address in the Wallet is recorded on Wallet-supported Blockchains. In certain circumstances, in order for the Operator to comply with its contractual obligations to You it may be necessary to write certain Personal Data, such as Your Personal Wallet Address, onto the relevant Blockchain. This is done through a Smart Contract and requires You to execute such Transactions using Your Personal Account’s Private Key. In most cases, ultimate decisions to (i) make Transactions on a Wallet-supported Blockchain using Your Personal Wallet Address, (ii) share the Public Key relating to Your Personal Wallet Address with anyone (including the Operator) must be made by You. By accepting this Privacy Policy You agree and understand that any such decision made by You with respect to Your Personal Wallet Address and Your Public Key will result in relevant data being recorded on the relevant Blockchain. By default, records on a decentralized Blockchain are immutable, meaning that once data is recorded on a Blockchain it cannot be changed or deleted. Although Smart Contract functionality may be used to revoke certain access rights, and some content and data, including Personal Data, may be obfuscated, i.e. made invisible to others, it is not and cannot be deleted from a Blockchain completely. By accepting this Privacy Policy You agree and understand that the data immutability feature of Wallet-supported Blockchains may affect Your ability to exercise Your certain rights with respect to Your Personal Data such as Your right to erasure of Your Personal Data (the right to be forgotten), or Your rights to object to processing or to restrict processing of Your Personal Data, if any such Personal Data is recorded on a Wallet-supported Blockchain. If You do not agree with Your Personal Data being recorded on Wallet-supported Blockchains, or with the discussed inability to exercise certain rights relating to Your Personal Data that may be recorded on Wallet-supported Blockchains, You may not create a Personal Account in the Wallet, submit any Personal Data to or with help of the Wallet, or otherwise access or use the Wallet in any way. By signing this section, you agree that you fully assume all possible/acceptable risks, losses, costs and any possible liability. Our company does not bear any possible responsibility. In case of liability for our company, its amount cannot exceed 100 US dollars. DATA PROCESSING BASES Operator relies on legal bases for processing Your Personal Data established, inter alia, under the GDPR. The applicable legal basis will depend on Your Personal Data at issue, the specific context in which it is collected, and the purposes for which it is used. Below is a list of how Operator may use Your Personal Data with the corresponding legal bases for processing. The Operator will process your Personal Datafor our legitimate interest to allow You to access and use the Wallet mobile software application and the Wallet online website version, to send You marketing content the Operator thinks may be of interest to You, to contact You if You leave Your contact details with the Operator or if You otherwise initiate contact with the Operator, and in instances whereprocessing is in the Operator’s or in its affiliates’ legitimate interests to operate business and not overridden by Your fundamental rights and freedoms. The Operator will rely on performing a contract to process Your Personal Data where the Operator is preparing to enter into a contract with Youor to take pre-contractual measures at Your request to entering into contracts, including other contracts with the Operator,or the Operator is carrying out its obligations under a contract with You, such asperformance under the Terms of Service, Associated Documents and any other contracts between the Operatorand You, to set up Your Personal Account in the Wallet for You and providing the Wallet to You. If the Operator needs to rely on consent, the Operator will ask for consent to process any of Your Personal Data for that specific purpose before the Operator commences processing your Personal Data for that reason. If You are under 18 (Eighteen) years of age, or are not of legal age in the jurisdiction from where You access and use the Wallet, the Operator will seek your parent or legal guardian’s consent to process Your Personal Data for that specific purpose. Upon written request, the Operator may provide You with a list of third parties the Operator may engage to process Your Personal Data. SAFEWALLET TERMS OF SERVICE RESTRICTIONS By accepting these Terms of Service You expressly agree that You are expressly prohibited to, and are prohibited to allow any third party to, perform any of the following actions, and any actions similar in nature or intent thereto, and that performance of any such actions shall constitute a material breach of these Terms of Service by You: ·display, copy, store, modify, adapt, reverse engineer, circumvent or bypass, sell, publish, make available to the public or redistribute the Wallet or any services, resources or functionality made available to You via the Wallet, or otherwise violate theIntellectual Property Rights Section hereof; ·allow any third party to access and use the Wallet using Your Personal Account login or any other credentials; ·use the Wallet for any illegal purposes, including but not limited to: storing, transmitting or attempting to exchange Digital Assets marked as dirty`` by crypto asset tracking service providers such as Crystal, Chainalysis, Ciphertrace, Elliptic and other similar crypto asset tracking service providers; performing dust attacks``; money laundering; financing of terrorism;illegal or otherwise prohibited trade; illegal gambling; fraud;and any other purposes that are or may be deemed illegal under any applicable local, national or international law or regulations; ·use the Wallet to store, trade or transmit Digital Assets that are proceeds of criminal or fraudulent activity, including but not limited to Digital Assets obtained from crypto scams, crypto exchange hacks, illegal transactions made via Darknet-based platforms, and any and all other criminal or fraudulent activities; ·make unsolicited offers or advertisements in or with help of the Wallet, or otherwise in connection with Your use of the Wallet; ·impersonate or falsely claim affiliation with any person or entity in connection with your use of the Wallet; ·misrepresent, defraud or defame others in connection with your use of the Wallet; ·negatively present the Wallet and/or the Operator and/or its subsidiaries or affiliates; ·transmit malicious software code in or with help of the Wallet; ·collect information of other Wallet Users without their explicit consent; ·interrupt the normal operation of or tamper with the Wallet or any content, or any functionality contained in or provided through the Wallet, or any servers used in providing the Wallet, or to unreasonably affect use of the Wallet by other Users in any way or manner whatsoever; ·misuse or gain unauthorized access to the Wallet by knowingly introducing viruses, cross-site scripting, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the Wallet; ·access without authority, interfere with, damage or disrupt any part of the Wallet, any equipment or network on which the Wallet is stored, any software used in the provision of the Wallet or any equipment or network or software owned or used by any third party; ·reverse engineer or bypass, circumvent, or attempt to bypass or circumvent any measures that the Operator may use to prevent or restrict access to the Wallet including, without limitation, other accounts, computer systems, platforms, applications, services or networks connected to the Wallet; ·disseminate or post spam, unreasonably large files, chain letters, information on pyramid (Ponzi) schemes, viruses or any other information or technologies that may harm the Wallet or any of its functionality, or the interest or property of other Users or the Operator and/or its subsidiaries and affiliates; ·promote or advertise any activity that is unlawful or illegal under the laws of any jurisdiction in connection with your use of the Wallet; ·disseminate information that is unlawful, pornographic, erotic,obscene, defamatory, libelous, threatening, discriminatory, harassing, bullying, vulgar, indecent, profane, hateful, racially, culturally or ethnically offensive, or that encouragescriminal conduct, or that gives rise, or potentially may give rise, to civil, administrativeor criminal liability, or that violates any applicable laws, rules, regulations, directives, treaties or guidelines, or that infringes or violates other parties (including other Users) intellectual property, publicity, or privacy rights or contains links to illegal,infringing or restricted content in connection with your use of the Wallet; ·link the Wallet to any software application or website or other online or offline resourcethat ordinarily contains or hosts content that is unlawful, pornographic, obscene, defamatory, libelous, threatening, discriminatory, harassing, bullying, vulgar, indecent, profane, hateful, racially, culturally or ethnically offensive, or that encourages criminal conduct, or that gives rise, or potentially may give rise, to civil, administrativeor criminal liability, or that violates any applicable laws, rules, regulations, directives, treaties or guidelines, or that infringe or violate other parties intellectual property, publicity, or privacy rights or contain links to infringing or unauthorized content; ·create an association between You and the Wallet and/or the Operatorand/or its subsidiaries and affiliates,and/or assert that You or Your actions in connection with your use of the Wallet are encouraged or officiallyendorsed by the Operator unless You are otherwise specifically permitted by the Operator to do soin writing; ·use bots, spiders, offline readers or other automated software systems to access or use theWallet; ·access and/or use the Wallet in jurisdictions where access to and/or use of the Wallet may be prohibited under applicable local or international laws; ·otherwise use the Wallet for engaging in any activities that areillegal under laws of any jurisdiction or that encourage criminal behavior and/or activities that are unlawful or fraudulent or have such purpose or effect or otherwise support any activities that breach any applicable local, national or international law or regulations; ·use the Wallet for any purposes other than those expressly permitted under these Terms of Service. Breach of this Restrictions Section of these Terms of Service shall constitute a material breach of these Terms of Service by You and a direct violation of any and all applicable laws. Unauthorized access and use of the Wallet, including any use in contravention of these Terms of Service and theRestrictions section of these Terms of Service, are expressly prohibited and may result in criminal prosecution and/or civil and/or administrative and/or disciplinary liability, including court action against You initiated by the Operator or relevant law enforcement authorities, and the Operator will cooperate with said authorities as required. Operator’s failure or omission to act does not deprive the Operator of the right to seek legal remedies against Your violation of this Section or to take any other lawful actions aimed at the enforcement of this Section or these Terms of Service. By signing this section, you agree that you fully assume all possible/acceptable risks, losses, costs and any possible liability. Our company does not bear any possible responsibility. In case of liability for our company, its amount cannot exceed 100 US dollars. You must independently verify and bear the risks associated with all your transactions. We cannot and should not know the correctness and intentions of the transactions you are making.
