SAFEWALLET TERMS OF SERVICE

Blockchainmeans a type of distributed ledger technology (DLT) solution that consists of a growing list of records called blocks that are securely linked together using cryptography, where each block contains a cryptographic hash of the previous block, Transaction data, and a timestamp that proves that the Transaction data existed at the moment of block creation.

CEXmean, collectively, centralized exchanges operated by TPSPs as they are defined herein, access to which may be available in the Wallet from time to time.

DAppsmean, collectively, decentralized applications operated by TPSPs, access to which may be available in the Wallet from time to time.

DEXmean, collectively, decentralized exchanges operated by TPSPs, access to which may be available in the Wallet from time to time.

Digital Assets mean, collectively, cryptographic tokens, cryptocurrencies, non-fungible tokens (NFTs), virtual commodities and other assets that may be defined as `virtual assets``, `cryptographic assets` and `digital assets` that are (i) supported by the Wallet from time to time, (ii) can be stored in the Wallet and (ii) swapped/exchanged using the Wallet functionality through Third-Party Resources. The full list of Digital Assets that a User can store in the Wallet and/or swap/exchange using the Wallet functionality is publicly available on the Wallet’s website and in the Wallet app description in mobile software app stores.

NFTsmean, collectively, non-fungible tokens on supported Blockchains that the Users may be able to store in the Wallet.

Personal Account means a User’s personal account within the Wallet and the connected wallet address for storing and exchanging cryptographic tokens that (i) contains information closed for public access and (ii) is created / generated once a User logs in the SAFE Wallet app or online website version thereof for the first time and completes the registration procedure. The Personal Account is accessed by entering authentication details in the Wallet login interface (for iOS and Android versions) or login web page (for the web version) using Your Credentials as they are defined herein.

Personal Wallet Address means a User’s personal, unique wallet address generated upon registration of the Personal Account for storing / transmitting Digital Assets that is generated upon registration of the Personal Account in the Wallet.

Private Key means a unique, secure cryptographic code / secret number that enables the Wallet Users to make Transactions with Digital Assets and prove ownership of their Digital Assets. Private Keys are stored within a User’s Personal Account on a User’s device(s) and, as the Wallet is a non-custodial solution, cannot be accessed, stored, or otherwise interacted with by the Operator.

Public Key means a unique, secure cryptographic code / secret number within the relevant Blockchain used to distinguish network participants from each other within the relevant Blockchain.

SAFE Wallet (the Wallet) means, collectively, the followingnon-custodial walletsoftware application and online resource(s) developed, managed and supported by the Operator and/or its subsidiaries and affiliates: (i) the interactive SAFE Walletsoftware application for the iOS and/or Android OS-based mobile device(s) available via the official Apple Inc.’s App Store, Google’s Google Play application store(s) and other software application stores for the iOS and/or Android OS-based mobile device(s) from time to time, and (ii) online (desktop) version of the Wallet available online on the Wallet’s official website at https://safecryptowallet.io, whichever may be applicable from time to time. The Wallet allows You to store and perform Transactions with Digital Assets using Your Personal Account and Your Personal Wallet Address by correlation of (i) Your Public Key and (ii) Your Private Key(s) or Smart Contract(s) to receive, manage, swap, exchange and send Digital Assets via integrated CEX, DApps and DEX operated by TPSPs as they are defined herein.

Seed Phrase means a cluster of random words generated by the Wallet upon registration of Your Personal Account, which is used for (i) accessing a User’s Personal Account and (ii) as an emergency backup if a User needs to restore access to his / her Personal Account and Digital Assets stored there.

Smart Contract means software code stored on a Blockchain that can be executed when predetermined conditions are met, including self-execution of Transactions. Smart Contracts are used to automate direct, peer-to-peer execution of Transaction(s) without involvement of intermediaries.

Third-Party Resources mean, collectively, any and all online websites, platforms and applications, including but not limited to CEX, DApps and DEX as they are defined herein, that (i) are provided, operated and controlled by third parties unaffiliated with the Operator, its subsidiaries, affiliates, officers or employees, (ii) which can be accessed and interacted with using the Wallet functionality, and (iii) may be used by the Operator to provide data on Digital Assets or propose services offered by such Third-Party Resources and their relevant TPSPs within the Wallet.

Third-Party Service Providers (TPSPs) mean, collectively, any and all third parties unrelated to and unaffiliated with the Operator, its subsidiaries and affiliates that are actual operators of Third-Party Resources that are available in the Wallet, such as CEX, DApps and DEX. TPSPs also include but are not limited to third-party payment service providers (PSPs) allowing You to purchase Digital Assets with your credit / debit bank cards.

Transactionmeans a change to the data set through a new entry in the continuous Blockchain.

Useror You means a natural person (individual) that (i) downloaded the Wallet software application to his / her mobile device or accessed the online website version thereof, (ii) created his / her Personal Account, and (iii) agreed to the Terms of Service and all Associated Documents as they are defined in these Terms of Service.

WalletOperator(the Operator) means CRYPTO EX FZCO company, a legal entity duly established and operating under the laws of United Arab Emirates, Registration No. DSO-FZCO-22641, having its registered address at:24369-001IFZA Business Park, DDP, and its subsidiaries and affiliates.

Your Credentials mean, collectively, Your Private Key and Seed Phrase used to access Your Personal Account in the Wallet.

Other terms and definitions in these Terms of Service have meanings attributed to them elsewhere in these Terms of Service and/or Associated Documents as the case may be.

GENERAL TERMS AND CONDITIONS

These Terms of Service constitute a legally binding agreement between the individual registering as a User of the Wallet and accessing and using the Wallet and accepting these Terms of Service and all Associated Documents as they are defined herein, including but not limited to the Privacy Policy, Cookie Policy, AML/CFT Policy and other Associated Documents as they are defined herein and included by reference herein (You)and the Wallet Operator with respect to Your access to and use of the Wallet, and its provisions may be enforced against You under applicable law. Please read and review these Terms of Service before commence using the Wallet.

By accessing or using the Wallet You acknowledge that You have read, understand and agree to be legally bound by all of the provisions of these Terms of Service and Associated Documents referenced herein without any limitations whatsoever. These Terms of Service are subject to change; please review these Terms of Service each time You access and/or use the Wallet. You acknowledge and agree that by accessing or using the Wallet, You shall be deemed as having accepted the most recent version of these Terms of Service. If You do not agree to comply with the provisions of and/or be bound by these Terms of Service, You may not access or use the Wallet in any way.

For the purposes of these Terms of Service the term `Wallet`includes but is not limited to the SAFE Walletsoftware application and web (online) version thereof, underlying software code, solutions, programs, algorithms, databases and hardware, all content available on or by means of the Wallet, all Wallet design elements and all of the interactiveservices, resources and functionality provided on or through the Wallet, and any and all other elements, componentsand parts of the Wallet without any limitation. You will be deemedusingthe Wallet anytime You access (via computer, mobile device or other technology) or otherwise interact or communicate with or connect to, the Wallet or any parts or sections thereof or participate in Digital Asset Transactions using the Wallet functionality.

These Terms of Service apply only and exclusively to the Wallet, apply only to Your rights and obligations in connection with Your use of the Wallet and do not apply to Your use of, or rights and obligations regarding, any other software applications or websites including but not limited to (i) any other software applications or websites that may be operated or offered by the Operator, its affiliates or other third parties, and (ii) Third-Party Resources provided and operated by TPSPs as they are defined herein.

By accepting these Terms of Service and Associated Documents and agreeing to be bound by them, You agree that Your access to and use of the Wallet must be at all times performed in strict accordance with the following rules:

·You must use the Wallet lawfully and in accordance with its designated purpose, solely and exclusivelyfor Your personal, household or private commercial purposes;

·Your accessing and use of the Wallet must be performed by You in full compliance with these Terms of Service, other applicable documents related to the Wallet, including but not limited to all Associated Documents as they are defined herein, and any and allany applicable local, national or international laws and regulations;

·You must obtain any and all consents, permissions or licenses that may be required for You to legally use the Wallet and store / exchange Digital Assets before You begin using the Wallet;

·You must always provide true and complete information about Yourself, including but not limited to Your personal data, incases such information is requested from You in the Wallet or directly by the Operator;

·You must at all times adhere to Your warranties and representations established in the User Warranties and Representations Section hereof;

·You must not perform or allow performance of any action listed in theRestrictionsor Intellectual Property Rights Sections of these Terms of Service, or violate any other restrictions established elsewhere in these Terms of Service or Associated Documents.

The Operator, its subsidiaries and affiliates are not sellers, buyers or exchangers of virtual (digital) assets. The Wallet is a purely technological software solution that provides its Users with certain functionality, such as storing and exchanging Digital Assets through Third-Party Resources as they are defined herein. Your access and use of the Wallet are subject to these Terms of Service.

The Wallet is a non-custodial wallet solution. Accordingly, You, and only You, are solely and exclusively responsible for the security of and are in control of Your Private Keys and Digital Assets, and only You can authorize transactions from your Wallet address from Your Personal Account. By accepting these Terms of Service You expressly acknowledge and agree that You are at all times solely and exclusively responsible for your activity and any risk of loss in connection with Your use of the Wallet.

In case of non-compliance with the requirements of the law and these Terms of Service Users undertake to independently bear responsibility before third parties, as well as before authorized regulatory and supervisory authorities, including law enforcement authorities.

ASSOCIATED DOCUMENTS

By accepting these Terms of Service and registering Your Personal Account in the Wallet You also accept by default the terms of the following binding legal documents which regulate other matters pertaining to Your use of the Wallet, constitute an integral part of these Terms of Service, and are part to or incorporated by reference herein (collectively, the Associated Documents):

·SAFE Wallet Privacy Policy, available here

·SAFE Wallet Cookie Policy, and;

·SAFE Wallet AML/CFT Policy, available as part to the these Terms.

Acceptance of these Terms of Service by You shall constitute Your express consent to be legally bound by the terms of, inter alia, Associated Documents.

By accepting these Terms of Service You expressly agree that the Associated Documents may establish other liability for violation of their terms, and undertake to conform to and comply with the terms of such Associated Documents for the full term of effect of these Terms of Service and/or the terms of effect of all such Associated Documents, whichever term of effect is longer.

By accepting these Terms of Service You expressly agree that, if the contrary is not expressly agreed between you and the Operator in the relevant written agreement, the terms of these Terms of Service followed by Associated Documents have legal priority over any other legal instruments and agreements (both direct and implied, notwithstanding the form of their expression) that may directly or indirectly relate to the relationship between You and the Operator.

USER ELIGIBILITY

To be eligible to register your Personal Account in the Wallet and access and use the Wallet, You must:

·be at least eighteen (18) years old and of legal age in your jurisdiction of domicile or from which you access and use the Wallet, whichever is applicable, and legally competent to enter into and accept these Terms of Service and all Associated Documents;

·be proficient in the Blockchain technology and Blockchain-based software systems, CEX, Dapps, DEX, their operation and functionality, usage, storage, transmission / Transaction mechanisms and specifics associated with Digital Assets as well as Digital Asset storage facilities, including but not limited to the Wallet, be an advanced–level user of these and other related technologies and solutions, and have relevant experience working with them;

·comply with any and all restrictions and prohibitions imposed on You in the jurisdiction of Your domicile, citizenship, residence or from which You access and use the Wallet that may be established with respect to (i) swapping / purchasing / owning Digital Assets, (ii) using the Wallet and similar technologies, (iii) accessing and using CEX, DApps and DEX, and (iv) other restrictions and prohibitions that may be imposed on You with respect to aforementioned;

·obtain at Your sole expense any and all licenses and permissions in Your jurisdiction of registration / residence / incorporation that may be applicable to Your use of the Wallet and provide a copy of such license and/or permission to the Operator if so requested or required by the Operator for Operator’s internal KYC purposes;

·successfully pass all tests, including the KYC compliance test, that may be provided to you by the Operator upon registration Your Personal Account in the Wallet for Operator’s internal KYC purposes;

·perform any and all actions and provide any and all additional documents, such as Your valid passport, other ID or proof of incorporation of a legal entity on behalf of which You access and use the Wallet, that may be requested by the Operator from You for Operator’s internal KYC purposes;

·not be the subject of or subject to economic sanctions such as the United Nations Security Council Sanctions List, the list of specially designated nationals maintained by the U.S.Treasury Department’s Office of Foreign Assets Control (OFAC), the denied persons or entity list of the U.S. Department of Commerce, or any similar list maintained by any other relevant sanctions authority in any jurisdiction whatsoever, not be listed on any similar list of prohibited or restricted parties, individuals and entities, and not act on behalf of any person or entity sanctioned thereunder;

·not be a resident of sanctioned jurisdictions according to any trade embargoes, United Nations Security Council Resolutions (UNSCR) or His Majesty’s Treasury`s financial sanctions regime,or any other sanctions regime whatsoever, and not be located in and/or accessing and/or using the Wallet from any jurisdiction that is the subject of any embargo by Operator jurisdiction, the United Kingdom, the European Union, the United States, UnitedNations Security Council (UNSC)or any other relevant jurisdiction, and not be listed on any list of prohibited or restricted parties by said authorities;

·have the full right, power, and authority to accept and enter into and comply with these Terms of Use and all Associated Documents on behalf of Yourself and/or any company or legal entity for which You may access or use the Wallet;

·not access or use the Wallet if your use thereof would or could potentially be illegal or otherwise violate any law You are or may potentially be subject to;

·at all times fully comply with the terms and conditions of these Terms of Service, all Associated Documents, and any and allapplicable local, national and international laws or regulations that are or may be applicable to Your access and use of the Wallet, or otherwise in connection with Your use of the Wallet.

USER WARRANTIES AND REPRESENTATIONS

By accessing and using the Wallet and accepting these Terms of Service and Associated Documents and agreeing to be bound by them, You expressly and explicitly represent and warrant that:

·You are of legal age in Your jurisdiction from which you access and use the Wallet;

·You will provide legitimate and lawful documentation proving your legal age or other status if so requested or required by the Operator for KYC purposes;

·Your use of the Wallet is legal under and compliant with the laws of Your jurisdiction or under the laws of any other jurisdiction to which You may be subject;

·You are not a citizen, resident, or member of any jurisdiction or group, and You do not act on behalf of any such citizen, resident, or member of any jurisdiction or group that is subject to any type or kind economic sanctions by Operator jurisdiction, the United Kingdom, the European Union, the United States, UnitedNations Security Council (UNSC)or any other relevant jurisdiction;

·You are not listed on any list of prohibited or restricted parties issued by any authority whatsoever, including but not limited to HMT Sanctions List, the U.S. Treasury Department’s Office of Foreign Asset Control’s sanctions lists, the U.S. commerce department`s consolidated screening list, the EU consolidated list of persons, groups or entities subject to EU Financial Sanctions, and You do not act on behalf of any person or entity listed therein or sanctioned thereunder;

·If you are using the Wallet on behalf of a legal entity, that legal entity is duly organized, validly exists and operates under the applicable laws of the jurisdiction of its incorporation, and that You are duly authorized by such legal entity to act on its behalf;

·You understand the Blockchain technology and Blockchain-based software systems, CEX, Dapps, DEX, their operation and functionality, usage, storage, transmission / Transaction mechanisms and specifics associated with Digital Assets as well as Digital Asset storage facilities, including but not limited to the Wallet, on an advanced level, and have relevant, advanced-level user experience working with them;

·You understand all existing and potential risks relating to Digital Assets, Transactions, the Blockchain technology and Blockchain-based software systems, CEX, Dapps, DEX, their operation and functionality, usage, storage, transmission / Transaction mechanisms and specifics associated with Digital Assets as well as Digital Asset storage facilities, including but not limited to the Wallet, including risk of loss of Digital Assets due to Blockchain hacks and Your own errors when transferring Digital Assets to any person or entity’s cryptographic wallet;

·You understand that Transactions on each Blockchain supported by the Wallet are irreversible and may not be erased, hidden or obfuscated, that Your Personal Wallet Address and Transactions are displayed permanently and publicly, and that due to these specifics of Blockchains You relinquish any right of rectification or erasure of Your personal data if any such personal data is written on the relevant Blockchain;

·You will not encourage or induce any TPSP to engage in any of the activities prohibited under these Terms of Service or any Associated Documents;

·You will not impersonate someone or use or attempt to use another user’s Personal Account / Personal Wallet Address without authorization or use the Wallet in any manner that could interfere, disrupt, negatively affect, or inhibit other Users from fully enjoying it;

·You will comply with any and all applicable tax obligations in Your jurisdiction of which You are a citizen, resident, or from which You access and use the Wallet, arising from Your use of the Wallet or otherwise in connection with Your use of the Wallet;

·You have read and understood These Terms of Service and all Associated Documents, and agree to be bound by their terms and conditions fully, irrevocably and unconditionally;

·You do not rely on, and shall have no remedy in respect of, any statement, representation, assurance or warranty (whether made innocently or negligently) that is not set out in These Terms of Service or any of the Associated Documents;

·You will not use the Wallet or interact with the Wallet in a manner that violates any law or regulation, including, without limitation, any applicable export control laws, as well as in non-compliance with these Terms of Service, including but not limited to theRestrictions and Intellectual Property Rights Sections hereof and/or any term or condition of any of the Associated Documents;

·You expressly and explicitly understand, agree and confirm that any violation by You of any terms and conditions of these Terms of Service and/or terms and conditions of any of the Associated Documents may result in unilateral termination of Your access to Your Personal Account by the Operator at its sole discretion without recourse to court, and may entail suspension of Your Digital Assets and Transactions with them and/or administrative and/or civil-law and/or criminal proceedings against You that may be brought by, inter alia, the Operator and/or relevant law enforcement authorities in any jurisdiction whatsoever.

PERSONAL ACCOUNT REGISTRATION AND SECURITY

Upon registration in the Wallet, You may be asked to provide certain registration details in order to access and use the Wallet. You expressly agree that all of the information You provide upon registration with the Wallet must be correct, truthful, current, accurate and complete. Providing misleading or false information is forbidden and constitutes a material breach of these Terms of Service. If the Operator believes that the information You provide is not correct, truthful, current, accurate or complete, or is false or misleading, the Operator has the right to refuse, suspend or terminate Your access to the Wallet or any of its functionality and to suspend or terminate Your Personal Account at any time.

When You register as a User of the Wallet and accept these Terms of Service, the Wallet will create for You a Personal Account and generate (i) a Personal Wallet Address, (ii) a Private Key for that Personal Wallet Address, (iii) a Seed Phrase to access your Personal Wallet Address and (iv) a Public Key associated with the relevant Private Key. The Private Key and the Seed Phrase are hereinafter collectively referred to as Your Credentials.

You are personally and solely responsible for any use of the Wallet with Your Credentials. For the avoidance of doubt, the Operator shall not be responsible for the security of your Private Key(s) and Seed Phrase (i.e. Your Credentials) or other means of authorization required to access Your Personal Account / Personal Wallet Address.

You agree to take due care in protecting Your Credentials against misuse by third parties and promptly notify the Operator about anyunauthorized use of Your Credentials or any other breach of security of Your Personal Account / Personal Wallet Addressvia the e-mail address listed in Contacts/or other contact details that may be provided by the Operator in the relevant section of the Wallet mobile application interface or Wallet website.

For avoidance of doubt, You acknowledge and agree that You shall assume all risks related to the use of the Wallet, Your Personal Account, Your Personal Wallet Address, and Your Credentials. When You create a Personal Account, You are strongly advised to take precautions in order to avoid loss of access to and/or control over Your Personal Account. Suggested measures include, but are not limited to:

·if this option is made available in the Wallet, creating a strong unique password that You do not use for any other purpose (i.e. different to Your phone password or any other passwords You use for websites, online services, etc.);

·if this option is made available in the Wallet and/on Your device(s), allowing biometric authentication using Face ID / fingerprint and/or-factor authentication (2FA);

·avoiding storing Your Credentials, i.e. the Private Key and Seed Phrase in plain text online or in an unsecured physical location;

·limiting access to Your devices and Your Personal Account / Personal Wallet Address;

·taking all necessary precautions against malware on Your device(s) and network(s) including but not limited to using proven anti-virus and anti-malware solutions;

·promptly notifying the Operator if You discover or otherwise suspect any security breaches related to Your Personal Account / Personal Wallet Address; and

·Notwithstanding anything to the contrary herein, the Operator shall have no liability whatsoever in connection with activities that occur on Your Personal Account / Personal Wallet Address with or without Your authorization.For the avoidance of doubt, the Operator hereby expressly and explicitly excludes any and all liability for any security breaches or other acts or omissions, which result in Your loss of access to Your Personal Account / Personal Wallet Address or custody or security of any Digital Assets stored therein.

WALLET AS A SERVICE

These Terms of Service establish the principles and conditions of Your access to and use of the Wallet as it is defined herein. The Wallet is a software application and online platform that are intellectual property of the Operator and/or its subsidiaries or affiliates, whichever is applicable, and which is maintained, operated and provided to You by the Operator.

The rights to access and use the Wallet are provided to you on a `software-as-a-service` (SaaS) basis. Initial registration with the Wallet, the rights of access to the Wallet and use of basic Wallet functionality such as ability to transfer Your Digital Assets to the Wallet, as well as certain operations such as receiving Digital Assets to the Wallet from third parties are provided free of charge, subject to the restrictions and prohibitions established herein.In addition, You may access and use the Wallet on your mobile or other device exclusively in accordance with its designated purpose, that is, for storing and exchanging Digital Assets as they are defined herein only through CEX, DApps and DEX that are (i) integrated into the Wallet, and (ii) operated by TPSPs, and using other functionality of the Wallet that may be made available for You within the Wallet from time to time.

For the avoidance of doubt, You are under no obligation, and the Operator is not obliged to demand from you, payment of any license, service fees or other fees to access and use the Wallet. Please note however, that Your use of any of its functionality being free of charge at a moment may become subject to certain fees being charged in the future. Any such fees that may be charged by the Operator in connection with the Wallet in the future will be announced separately and be made available via Your Personal Account, in the Wallet app, on the Wallet’s official website, or otherwise at the Operator’s sole discretion.

WALLET FUNCTIONALITY

The Wallet allows Users to:

·generate Personal Wallet Addresses and associated Private Keys and Public Keys that You may use to send and receive Digital Assets;

·purchase Digital Assets using (i) supported cryptocurrencies, and (ii) your credit / debit bank card with the assistance of the relevant TPSP;

·browse and access Third-Party Resources such as CEX, DApps and DEX operated by TPSPs through the Wallet;

·swap/trade Digital Assets through CEX / DApp / DEX functionality made available by TPSPs;

·view Digital Asset price information made available by TPSPs in the Wallet;

·broadcast Digital Asset Transaction data to various Blockchains supported by the Wallet without requiring You to download or install the associated Blockchain-based software to Your device;

·other functionality that may be introduced in the Wallet from time to time as the case may be.

CEX, DAPPS AND DEX

If You access or use particular Third-Party Resources from the Wallet, such as CEX, DApps or DEX, including, without limitation, CEX / DApp / DEX functionality available within the Wallet such as the `Exchange / Swap Digital Assets` option or alike, You expressly acknowledge and agree that:

·the Operator is not responsible for Your access or use of CEX, DApps or DEX and shall have no liability whatsoever in connection with Your use of CEX, DApps or DEX, including, without limitation, any Transactions You dispute, and any and all such disputes shall be brought by You exclusively to or against TPSPs owning / operating such CEX / DApps / DEX;

·the limits of amounts that You may swap / exchange via a particular CEX / DEX per day shall be subject to any requirements of Smart Contracts developed by TPSPs owning / operating such CEX / DEX;

·Blockchain Transactions are irrevocable meaning when You conduct any Transactions via CEX, DApps or DEX, You shall be solely responsible for the consequences of any issues associated with such Transactions, including, without limitation, Your transfer of Your Digital Assets to an incorrect address or problems associated with the node servers selected by You;

·when You use CEX, DApps or DEX, Smart Contracts developed by their relevant TPSPs they may charge You handling fees and/or service fees and any information displayed on the Wallet relating to such fees are for Your reference only as the Operator cannot and does not guarantee its accuracy, applicability, reliability, integrity or appropriateness, nor shall the Operator be liable for any loss or damage that may be caused directly or indirectly by Your use of said information; and

·the Operator may charge no service fees or handling fees for the use of CEX, DApps or DEX, however, the Operator may, at its sole discretion, charge such fees at any time in the future, and any such updated fees will apply to any Transaction that occurs following the effective date of such updated fees.

PURCHASING DIGITAL ASSETS

You may purchase Digital Assets through the Wallet either with supported cryptocurrencies or credit / debit bank cards.

If You use the Wallet to purchase Digital Assets with Your credit or debit bank card, a relevant TPSP will convert Your chosen amount into the applicable Digital Asset and credit it to Your Personal Wallet Address. You expressly and explicitly acknowledge and agree that:

·the Operator is not responsible for Your use of such Third-Party Resource for Digital Asset purchasing purposes and shall have no liability whatsoever in connection with Your use of such Third-Party Resource for these purposes;

·You will be subject to any terms and conditions imposed by the relevant TPSP with respect to Digital Asset purchases;

·the Operator has no ability to change, withdraw or cancel any conversion requests You place in the Wallet or on the relevant Third-Party Resource for Digital Asset purchases;

·the Operator is not responsible for any purchase / exchange rates offered by the relevant TPSP;

·the Operator is not responsible for any fees charged by the relevant TPSP or Your bank or credit card issuer(s) for purchasing Digital Assets with Your credit / debit bank card; and

·the Operator is not responsible for any and all queries, claims, charges or actions which may be raised, brought against You or otherwise initiated against You by Your bank or other payment services provider or any authority in any jurisdiction whatsoever in respect of the Transactions made via the Wallet, including but not limited to instances of credit / debit card blocking and denial of service by such parties.

DIGITAL ASSET TRANSACTIONS

In order for all proposed / initiated Digital Asset Transactions to be completed, they must be confirmed and recorded in the Digital Asset’s associated public Blockchain supported by the Wallet. These Blockchains are decentralized, peer-to-peer networks owned, operated and/or supported by independent TPSPs, which the Operator does not own, control, or operate. The Operator has no control over these Blockchains and as a result cannot and does not ensure or guarantee or warrant that any Transaction details that You submit via the Wallet will be confirmed and processed.

By using the Wallet, You acknowledge and agree that:

·the Operator does not have the ability to cancel or otherwise modify Your Transactions;

·the Transaction details You submit may not be completed, or may be substantially delayed, by the applicable Blockchain(s);

·the Operator and its subsidiaries or affiliates do not store, send or receive Digital Assets, and are no party to any Transaction; and

·any Transaction in relation to any Digital Asset occurs on the relevant Blockchain and not on a network owned by the Operator or any of its subsidiaries or affiliates; therefore, the Operator may not and does not guarantee the transfer of title or right in any Digital Asset as a result of any such Transaction.

Further to the above, You expressly accept and acknowledge that the Operator is not and may not be held responsible for any errors or omissions that You may make in connection with any Digital Asset Transaction initiated via the Wallet. The Operator strongly encourages You to review details of each Transaction carefully before initiating a Digital Asset Transaction.

There may be Transaction fees (e.g. mining fees) associated with Your Digital Asset Transactions that are required by the Digital Asset system or the relevant Blockchain that You engage with. You must ensure that You have an adequate balance on Your Personal Wallet Address and/or `gas` to complete Transactions before initiating a Transaction. You acknowledge and agree that the Operator will not be liable for any failed Transactions or losses You may incur due to incorrectly set Transaction fees (i.e. too low or too high) or due to insufficient funds or gas associated with Your Personal Wallet Address. You further acknowledge and agree that, as the Wallet is a non-custodial solution, the Operator does not have access to Your or anyone else’s Transactions.

PRIVACY AND PERSONAL DATA

The information required to be provided in connection with Your use of the Wallet may include certain personal data. Collection, use and processing of Your personal data by the Operator are governed by theSAFE Wallet Privacy Policy, available following the link given before. You hereby consent and agree that Your access and use of the Wallet constitutes automatic acceptance of the SAFE Wallet Privacy Policy, incorporated herein by reference.

You agree that when You provide any personal data via the Wallet or in connection with Your use of the Wallet You do so upon having reviewed and agreed to these Terms of Service and the Privacy Policy, that You provide Your personal data consciously and that Your personal data is collected, processed and stored based on Your express consent and approval.

COOKIE POLICY

The Wallet may deploy or will deploy certain data files to be stored in Your web or mobile browser and/or on Your computer and/or mobile device, designated for `remembering` You and Your activities in the Wallet mobile application and/or while visiting the Wallet’s website (the `cookie` files). Use of cookie files by the Operator and the Wallet is governed by the SAFEWallet Cookie Policy. You hereby consent and agree that Your use of the Wallet constitutes automatic acceptance of the SAFE Wallet Cookie Policy, incorporated herein by reference.

GEOLOCATION

When you access and use the Wallet mobile application and/or while visiting the Wallet’s website it may collect actual geographical coordinates (or other geolocation data) of Your device from which you access and use the Wallet. Collection and use of geolocation data is required for the correct functioning of the Wallet, Operator’s compliance with jurisdictional restrictions, and performance of these Terms of Service, and are governed by theSAFE Wallet Privacy Policy, available as shown above.

INTERACTION WITH OTHER USERS

Certain functionality of the Wallet is designed and designated for interaction with and between Users of the Wallet. Your interaction and communication with other Users must be at all times performed in strict accordance with these Terms of Service.

You must treat all other Users of the Wallet with dignity and respect, and respect the privacy and opinions of other Users. Any communication with, or action against, other Users of the Wallet that is performed in violation of these Terms of Service or general principles of normal human communication and behavior are expressly prohibited and may result in suspension or termination of Your Personal Account, as well as Your prosecution if Your behavior in connection with Your use of the Wallet may be deemed illegal or unlawful under any applicable law.

ADDITIONAL FUNCTIONALITY, PRODUCTS AND SERVICES

In the future, the Operator may provide You access to additional functionality of the Wallet, free of charge or charging a certain fee. The provision of additional functionality does not expand Your rights to access and to use the Wallet under these Terms of Service.

The amount of fees for additional functionality, if any such fees will be charge by the Operator in the future, shall be made available to Users via Personal Accounts in the Wallet.

Any and all personal data that may be collected in the process of payment by You of the fees discussed in this Section shall be processed in accordance with the SAFE Wallet Privacy Policy, mentioned above.

CONTESTS, GAMES AND ADVERTISING

Certain information and materials made available to Wallet’s Users or otherwise distributed via the Wallet may be classified as advertising under applicable law. By accepting these Terms of Service and using the Wallet You grant to the Operator Your express consent to view and receive advertising materials and information made available to Wallet’s Users or otherwise distributed via the Wallet, notwithstanding the origin of the advertisement and of the advertising entity or individual.

In addition to advertising, the Wallet may contain information on offers of, or directly offer participation in various games, contests, advertising activities and other similar activities offered and organized by the Operator, its subsidiaries or affiliates, or third parties selected by the Operator. You understand and agree that each and every such activity is or may be governed by a standalone document setting forth the terms and conditions of Your participation and general rules of such activities, which documents may include, without limitation, game rules, contest rules, and end user license agreements. Acceptance of these Terms of Service and use of the Wallet does not automatically constitute Your agreement to be bound by any and all such documents, but it is provided that You have to agree to be bound by any and all of them. Your engagement in any such activities shall be deemed to be an automatic consent to any and all terms, conditions and rules that may be imposed by any such documents, and shall be governed by these documents only. You also agree and confirm that these Terms of Service do not regulate any such activities.

NETWORK SECURITY AND ACTION REQUIRED BY LAW

Your use or distribution of tools designed for compromising security or collecting information (e.g., password guessing programs, keygens, `cracking`` tools, `spiders``, or other network probing tools) in connection with the Wallet is strictly prohibited. If You become involved in any violation of the Wallet system security, the Operator reserves the right to release Your details to system administrators and operators of other software applications and websites, including software applications and websites not directly related to the Wallet and/or operated by the Operator or any of its affiliates in order to assist them in resolving or preventing security incidents.

The Operator reserves the right to cooperate fully with law enforcement authorities or court orders requesting or directing the Operator to disclose the identity of, or other information about, anyone publishing or otherwise making available via the Wallet any information or materials that are believed to violate these Terms of Service or applicable law, including You.

In addition to the foregoing, the Operator may need to comply with lawful interception and/or data retention requirements imposed by Your country of residence or any other country in which You access and use the Wallet. The Operator may restrict access to any part of the Wallet or terminate Your access to the Wallet, at any time in its sole discretion if required by law or by the relevant authorities or regulatory agencies to do so.

THIRD-PARTY RESOURCES

By accepting these Terms of Service, You acknowledge that the Wallet may contain hyperlinks or references to other software applications, websites or online platforms, such as cryptocurrency exchanges, that are not maintained by, or related to, the Operator or its subsidiaries or affiliates and over which the Operator and its subsidiaries and affiliates have no direct or indirect control whatsoever and which are owned and/or operated by TPSPs as they are defined herein (Third-Party Resources). The Operator may provide, via the Wallet, links to Third-Party Resources such as CEX, DApps and DEX for Users’ convenience or reference, and such Third-Party Resources, unless otherwise provided directly by the Operator, are not and shall not be viewed as sponsored or endorsed by or recommended by or affiliated with the Wallet or in any other way supported by the Operator or its subsidiaries or affiliates and may not be interpreted as Operator’s affiliation with or endorsement of any TPSP owning or operating any such Third-Party Resource.

You further acknowledge that the Operator has noexplicit or implicitobligation to review, has not reviewed and does not review the content of such Third-Party Resources and is not responsible for the contents of any of those Third-Party Resources.As a result, the Operator makes no representations concerning any TPSP content contained in or accessed through the Wallet and/or on Third-Party Resources and makes no representations or warranties about the content, completeness, safety, or accuracy of any hyperlinks to Third-Party Resources and/or their content made available in the Wallet, specifically disclaims any and all responsibility and liability for any content, software, functionality, websites or advertised products (goods, works or services) available via such Third-Party Resources or other Internet or mobile resources, and shall have no liability for any damages or injuries of any kind arising from the content or information of such Third-Party Resources, including any actual (inflicted) or potential damages or injuries suffered from infringement of third-party intellectual property rights or from purchase of the goods, works or services, including Digital Assets exchange services, through Third-Party Resources.

You access and use any Third-Party Resources accessible through hyperlinks in the Wallet at Your sole risk and at Your sole discretion. Upon accessing any such Third-Party Resource, You must review and agree to the terms of use of the relevant Third-Party Resource before using it, and any other terms, conditions, warranties, or representations associated with content available on such Third-Party Resources are solely between You and such TPSPs.

In addition, use of the Wallet by You is governed by these Terms of Service, but may also be subject to any rules or policies applied by any third party platform providers with whose devices and/or operating systems the Wallet software application has/have been designed to be compatible with, including Apple Inc.’s App Store and Google Inc’s Google Play. These third party application stores are operated by the relevant third party platform providers and/or their affiliates, including Apple Inc. and Google Inc. You must comply with all applicable terms of service, rules and policies applying to these third party application stores from which you download the Wallet software application, as they may be amended from time to time. The Operator is not responsible for these third party application stores for anything provided by them and may not and does not guarantee that they will be continuously available.

The Operator retains the exclusive right to add to, modify, or cancel the availability of any Third-Party Resource at any moment and at its sole discretion.

In addition to the foregoing, Your interactions and dealings with persons found on or through the CEX / DApps / DEX or any other Third-Party Resource, including payment and delivery of goods and services, financial transactions, and any other terms associated with such dealings, are solely between You and such persons. You agree that the Operator shall not be responsible or liable for any loss or damage of any sort incurred by You as the result of any such dealings.

Furthermore, third-party content, software applications and websites, including Third-Party Resources, may be terminated or interrupted at any time by their respective operators, and the Operator makes no representation or warranty that any content, software application or website will remain available for any period of time. The Operator expressly disclaims any responsibility or liability for any termination, interruption or suspension of any third-party content, software application or website, including but not limited to Third-Party Resources referenced in the Wallet. The Operator is, and may not be held, neither responsible nor liable for any Third-Party Resources. Any question or request relating to Third-Party Resources should be made directly to the relevant Third-Party Resource(s) operator(s).

RESTRICTIONS

By accepting these Terms of Service You expressly agree that You are expressly prohibited to, and are prohibited to allow any third party to, perform any of the following actions, and any actions similar in nature or intent thereto, and that performance of any such actions shall constitute a material breach of these Terms of Service by You:

·display, copy, store, modify, adapt, reverse engineer, circumvent or bypass, sell, publish, make available to the public or redistribute the Wallet or any services, resources or functionality made available to You via the Wallet, or otherwise violate theIntellectual Property Rights Section hereof;

·allow any third party to access and use the Wallet using Your Personal Account login or any other credentials;

·use the Wallet for any illegal purposes, including but not limited to: storing, transmitting or attempting to exchange Digital Assets marked as `dirty`` by crypto asset tracking service providers such as Crystal, Chainalysis, Ciphertrace, Elliptic and other similar crypto asset tracking service providers; performing `dust attacks``; money laundering; financing of terrorism;illegal or otherwise prohibited trade; illegal gambling; fraud;and any other purposes that are or may be deemed illegal under any applicable local, national or international law or regulations;

·use the Wallet to store, trade or transmit Digital Assets that are proceeds of criminal or fraudulent activity, including but not limited to Digital Assets obtained from crypto scams, crypto exchange hacks, illegal transactions made via Darknet-based platforms, and any and all other criminal or fraudulent activities;

·make unsolicited offers or advertisements in or with help of the Wallet, or otherwise in connection with Your use of the Wallet;

·impersonate or falsely claim affiliation with any person or entity in connection with your use of the Wallet;

·misrepresent, defraud or defame others in connection with your use of the Wallet;

·negatively present the Wallet and/or the Operator and/or its subsidiaries or affiliates;

·transmit malicious software code in or with help of the Wallet;

·collect information of other Wallet Users without their explicit consent;

·interrupt the normal operation of or tamper with the Wallet or any content, or any functionality contained in or provided through the Wallet, or any servers used in providing the Wallet, or to unreasonably affect use of the Wallet by other Users in any way or manner whatsoever;

·misuse or gain unauthorized access to the Wallet by knowingly introducing viruses, cross-site scripting, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the Wallet;

·access without authority, interfere with, damage or disrupt any part of the Wallet, any equipment or network on which the Wallet is stored, any software used in the provision of the Wallet or any equipment or network or software owned or used by any third party;

·reverse engineer or bypass, circumvent, or attempt to bypass or circumvent any measures that the Operator may use to prevent or restrict access to the Wallet including, without limitation, other accounts, computer systems, platforms, applications, services or networks connected to the Wallet;

·disseminate or post spam, unreasonably large files, chain letters, information on pyramid (Ponzi) schemes, viruses or any other information or technologies that may harm the Wallet or any of its functionality, or the interest or property of other Users or the Operator and/or its subsidiaries and affiliates;

·promote or advertise any activity that is unlawful or illegal under the laws of any jurisdiction in connection with your use of the Wallet;

·disseminate information that is unlawful, pornographic, erotic,obscene, defamatory, libelous, threatening, discriminatory, harassing, bullying, vulgar, indecent, profane, hateful, racially, culturally or ethnically offensive, or that encouragescriminal conduct, or that gives rise, or potentially may give rise, to civil, administrativeor criminal liability, or that violates any applicable laws, rules, regulations, directives, treaties or guidelines, or that infringes or violates other parties (including other Users) intellectual property, publicity, or privacy rights or contains links to illegal,infringing or restricted content in connection with your use of the Wallet;

·link the Wallet to any software application or website or other online or offline resourcethat ordinarily contains or hosts content that is unlawful, pornographic, obscene, defamatory, libelous, threatening, discriminatory, harassing, bullying, vulgar, indecent, profane, hateful, racially, culturally or ethnically offensive, or that encourages criminal conduct, or that gives rise, or potentially may give rise, to civil, administrativeor criminal liability, or that violates any applicable laws, rules, regulations, directives, treaties or guidelines, or that infringe or violate other parties intellectual property, publicity, or privacy rights or contain links to infringing or unauthorized content;

·create an association between You and the Wallet and/or the Operatorand/or its subsidiaries and affiliates,and/or assert that You or Your actions in connection with your use of the Wallet are encouraged or officiallyendorsed by the Operator unless You are otherwise specifically permitted by the Operator to do soin writing;

·use bots, spiders, offline readers or other automated software systems to access or use theWallet;

·access and/or use the Wallet in jurisdictions where access to and/or use of the Wallet may be prohibited under applicable local or international laws;

·otherwise use the Wallet for engaging in any activities that areillegal under laws of any jurisdiction or that encourage criminal behavior and/or activities that are unlawful or fraudulent or have such purpose or effect or otherwise support any activities that breach any applicable local, national or international law or regulations;

·use the Wallet for any purposes other than those expressly permitted under these Terms of Service.

Breach of this Restrictions Section of these Terms of Service shall constitute a material breach of these Terms of Service by You and a direct violation of any and all applicable laws. Unauthorized access and use of the Wallet, including any use in contravention of these Terms of Service and theRestrictions section of these Terms of Service, are expressly prohibited and may result in criminal prosecution and/or civil and/or administrative and/or disciplinary liability, including court action against You initiated by the Operator or relevant law enforcement authorities, and the Operator will cooperate with said authorities as required.

Operator’s failure or omission to act does not deprive the Operator of the right to seek legal remedies against Your violation of this Section or to take any other lawful actions aimed at the enforcement of this Section or these Terms of Service.

CONSENT TO MONITOR

The Operator reserves the right, but is under no obligation, to monitor Your Personal Account, Your Personal Wallet Address, and Your activities in the Wallet related to Your Personal Account for the purposes of confirming that You use the Wallet in full accordance with these Terms of Service and applicable law. You hereby grant the Operator Your express permission and consent to monitor Your Personal Account and all activities performed under Your Personal Account for purposes of confirming legal use of the Wallet and identifying instances of restricted use and potential violations of these Terms of Service and applicable law.

CLAIMS OF IP RIGHTS INFRINGEMENT

If You believe that any content contained or appearing in the Wallet infringes Your intellectual property rights or intellectual property rights of third parties that You are authorized to represent, please send the following information (collectively,Infringement Claim) in writing to e-mail listen in Contacts:

·Your name, address, telephone number, and e-mail address;

·a description of the intellectual property right that You claim has been infringed;

·description of each place where alleged infringing material is located;

·a statement by You that You have a good faith belief that the disputed use has not been authorized by You, Your agent or other representative, or under applicable law;

·Your electronic (if applicable) or physical signature or the electronic or physical signature of the person authorized to act on Your behalf; and

·a statement by You that the information in Your Infringement Claim is accurate, with the description of the actual owner of intellectual property rights that are deemed infringed.

Your personal data provided to the Operator in connection with the Infringement Claim will be processed in accordance with theSAFE Wallet Privacy Policy, mentioned bove.

REPORTING ABUSE

You may report to the Operator abuse by other Users of the Wallet, as well as Users engaged in activities listed in the RestrictionsSection of these Terms of Service, by sending an e-mail to the relevant address listen in Contacts.

REPORTING VIOLATIONS OF TERMS OF SERVICE

You may inform the Operator about violations of these Terms of Service by other Users of the Wallet by sending an e-mail to the relevant address listen in Contacts.

SUSPENSION/TERMINATION OF PERSONAL ACCOUNT

You may terminate Your access and use of the Wallet if You no longer wish to use the Wallet by deleting Your Personal Account and subsequently deleting the Wallet from Your device (if applicable).

The Operator reserves the right to investigate any and all suspected violations of these Terms of Service and to take any and all necessary or appropriate actions to remedy such violations, as the Operator may determine appropriate including termination of the personal account. The Operator may suspend, terminate, modify, or restrict Your access to the Wallet at any time at its sole discretion, with or without notice to You, if there is an indication that You have breached these Terms of Service.

If You are found to be in a material breach of these Terms of Service, including but not limited to being found in violation of theRestrictionssection of these Terms of Service, by using the Wallet for illegal purposes or infringing Operator’s or third parties’ (including other Users’) rights, the Operator reserves the right to both suspend Your Personal Account for an indeterminable amount of time and notify the relevant government officials, including law enforcement authorities, in the relevant jurisdiction(s) if Your actions may be classified as illegal and punishable under applicable laws.

ACCESS, UPTIME AND AVAILABILITY

The Wallet may not be available in some countries and may be provided only in selected languages. The Wallet may be network dependent. The Operator reserves the right, in its sole discretion, to change, update, modify, improve and correct the Wallet. The Wallet may not be available during maintenance breaks and other times. The Operator may decide to discontinue the Wallet or any part thereof in its sole discretion and at any given moment. The Operator does not represent or warrant that the Wallet, or any part or functionality thereof, is appropriate or available for use in any particular jurisdiction, and does not represent or warrant that Your access to and use of the Wallet will be error-free, virus-free, uninterrupted, and that the servers on which the Wallet is deployed will be up permanently.

NO RIGHT OF FUTURE ACCESS

These terms of service do not grant you any rights with respect to your future access to and use of the wallet. You expressly acknowledge and agree that the operator may, in its sole discretion and at any time, change, modify, add, remove, disable or discontinue the Wallet or any parts thereof and/or any of its current or future functionality or limit or restrict any User, including you,access thereto, for any reason, at its sole discretion, at any time with or without prior notice. You understand and agree that the Operator may take any one or more of these actions without any notice to You, prior or otherwise, and you understand and agree that neither the Operator nor any of its subsidiaries and affiliates shall have any liability to You or to any other person for any termination of Your or anyone else`s access to the Wallet, its functionality or part or all of elements components thereof and/or termination of Your personal account and/or removal or purging or deactivation of any other information or data that You or anyone else may have provided on or by means of the Wallet.

DISCLAIMER OF WARRANTIES

BY ACCEPTING THESE TERMS OF SERVICE AND ACCESSING AND USING THE WALLET YOU EXPRESSLY AND EXPLICITLY CONFIRM AND AGREE THAT YOU UNDERSTAND THAT THE WALLET IS A SOFTWARE PROGRAM IN ITS EARLY DEVELOPMENT STAGESAND THE WALLET, BEING A SOFTWARE PROGRAM, IS REGULARLY UPDATED AND EVOLVES OVER TIME. You expressly acknowledge and agree that You access and use the Wallet at Your sole discretion and Your sole risk. The Wallet, and any portion, element, FUNCTIONALITY or component of the Wallet, including but not limited to anyINTERACTIVE SERVICEs AND FUNCTIONALITY available to You throughAND IN the Wallet are provided `As is`, `With all faults` and `As available`. TO THE FULLEST EXTENT PERMITTED BYany applicable LAW, the Operator AND ITS SUBSIDIARIES AND AFFILIATES EXPRESSLY DISCLAIM ANY AND ALL WARRANTIES OF ANY KIND with respect to theWALLET, WHETHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR USE OR PURPOSE AND NON-INFRINGEMENT. To the maximum extent allowed under any Applicable Law, neither the Operator nor any of its SUBSIDIARIES AND affiliates make any warranties or representations about the accuracy or completeness of content available on or through the Wallet or the content of any othersoftware applications, Internet or mobile resources relatingto the Wallet or links to which are contained in the Wallet, INCLUDING BUT NOT LIMITED TO THIRD-PARTY RESOURCES.

THIRD-PARTY DATA ON DIGITAL ASSETS

The wallet may contain or provide information on, including but not limited to, the price, range, bid/ask spread, volume, volatility of digital assets supported by the Wallet that is automatically collected by the Wallet from third-party resources that are operated by TPSPs. By accepting these terms of service you expressly acknowledge and agree that the Operator, its subsidiaries and affiliates may not and will not bear any liability for the completeness, truthfulness, accuracy or relevance of any such data collected by the Wallet from third-party resources owned and/or operated by TPSPs.

NO PARTY TO TRANSACTIONS

By accepting these terms of service and accessing and using the Wallet You expressly and explicitly confirm and agree that You are informed that the Operator and the Wallet do not provide digital asset purchase, sale, swap or exchange services directly or indirectly. The Operator only grants You limited right to use the Wallet as a service in accordance with its designated purpose and terms and conditions herein. The Operator, its subsidiaries and affiliates are not parties to relevant transactions made via the Wallet and shall bear no responsibility for any such transactions.

NO FINANCIAL ADVICE

NONE OF THE CONTENT, CONTAINED, REFLECTED OR AVAILABLE IN OR VIA THE WALLET OR ITS WEBSITE CONTAINS INVESTMENT, FINANCE, ACCOUNTING, TAX OR SECURITY TRADING ADVICE, OR SERVES AS A PROFESSIONAL ADVIСE ON ANY OTHER ISSUES, OR CONSTITUTES OFFERS, TRADING SIGNALS, INSTRUCTIONS OR SOLICITATIONS TO MAKE ANY DIGITAL ASSET OR FINANCIAL TRANSACTIONS. ANY AND ALLDECISIONS TO ENGAGE IN DIGITAL ASSET TRANSACTIONS OR PERFORM OPERATIONS INVOLVING DIGITAL ASSETS SHOULD BE TAKEN ON YOUR OWN ACCORD AND AT YOUR OWN RISK.

THESE TERMS OF SERVICE ARE NOT INTENDED TO CREATE AND DO NOT CREATE OR IMPOSE ANY FIDUCIARY DUTIES ON THE OPERATOR,ITS SUBSIDIARIES, AFFILIATES, LICENSORS, WEBSITE AND HOSTING SERVICES PROVIDERS, CONTENT PROVIDERS, EMPLOYEES, OFFICERS, DIRECTORS, AND AGENTS AND ANY OTHER APPROPRIATE PARTY. TO THE FULLEST EXTENT PERMITTED BY ANY APPLICABLE LAW, YOU ACKNOWLEDGE AND AGREE THAT THE OPERATOR, ITS SUBSIDIARIES, AFFILIATES, LICENSORS, WEBSITE AND HOSTING SERVICES PROVIDERS, CONTENT PROVIDERS, EMPLOYEES, OFFICERS, DIRECTORS, AND AGENTS OR ANY OTHER APPROPRIATE PARTYOWE NO FIDUCIARY DUTY OR LIABILITIES TO YOU OR ANY OTHER PARTY WHATSOEVER. TO THE EXTENT ANY SUCH DUTIES MAY POTENTIALLY EXIST AT LAW OR IN EQUITY, THOSE DUTIES AND LIABILITIES ARE HEREBY EXPRESSLY AND IRREVOCABLY DISCLAIMED, WAIVED AND ELIMINATED. YOU AGREE THAT THE ONLY DUTIES AND OBIGATIONS THAT THE OPERATOR,ITS SUBSIDIARIES, AFFILIATES, LICENSORS, WEBSITE AND HOSTING SERVICES PROVIDERS, CONTENT PROVIDERS, EMPLOYEES, OFFICERS, DIRECTORS, AND AGENTS AND ANY OTHER APPROPRIATE PARTYMAY POTENTIALLY OWE YOU ARE THOSE EXPRESSLY ESTABLISHED IN THESE TERMS OF SERVICE AND ASSOCIATED DOCUMENTS.

NO TAX AGENT

It is Your responsibility to determine what, if any, taxes apply to the Transactions that You have submitted Transaction details for via the Wallet. It is Your sole and exclusive responsibility to report and remit the correct tax to the appropriate tax authority / authorities. You agree that the Operator is not and may not be held responsible for determining whether taxes apply to Your Transactions, Digital Assets you own, control or store using the Wallet or for collecting, reporting, withholding, or remitting any taxes arising from any Digital Asset-related Transactions. For the avoidance of doubt, the Operator or any of its subsidiaries and affiliates may not be recognized and are not Your tax agents with respect to any of Your Transactions and Digital Assets.

LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL THE OPERATOR, OR ITS SUBSIDIARIES AND AFFILIATES, OR ANY OF THEIR RESPECTIVE SHAREHOLDERS, MEMBERS, DIRECTORS, OFFICERS, EMPLOYEES, ATTORNEYS, AGENTS, REPRESENTATIVES, SUPPLIERS OR CONTRACTORS BE LIABLE FOR ANY DIRECT DAMAGES OR INCIDENTAL, INDIRECT, ACTUAL, SPECIAL, EXEMPLARY, PUNITIVE, CONSEQUENTIAL OR SIMILAR DAMAGES OR LIABILITIES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF DATA, INFORMATION, REVENUE, PROFITS, INCOME OR OTHER BUSINESSES OR FINANCIAL BENEFITS,PAIN AND SUFFERING, EMOTIONAL DISTRESS, DAMAGES FOR LOSS OF GOODWILL OR ANY OTHER INTANGIBLE LOSSES) WHETHER UNDER CONTRACT, TORT, NEGLIGENCE, STATUTE, STRICT LIABILITY OR OTHER THEORY EVEN IF THE OPERATOR HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, ARISING OUT OF YOUR ACCESS OR USE OF THE WALLETOR INABILITY TO ACCESS AND/OR USE THE WALLET OR ANY PART, FUNCTIONALITY OR component THEREOF, INCLUDING, BUT NOT LIMITED TO: ANY UNAUTHORIZED USE OF YOUR PERSONAL WALLET ADDRESS AND/OR PRIVATE KEY AND/OR SEED PHRASE DUE TO YOUR FAILURE TO MAINTAIN THE CONFIDENTIALITY OF YOUR PERSONAL WALLET ADDRESS AND/OR ANY OF YOUR CREDENTIALS, ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE WALLET OR ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE THAT ARE FOUND IN THE WALLET SOFTWARE OR THAT MAY BE TRANSMITTED TO OR THROUGH OUR WALLET BY ANY THIRD PARTY (REGARDLESS OF THE SOURCE OF ORIGIN); ANY ACTIONS THE OPERATOR TAKES OR FAILS TO TAKE AS A RESULT OF COMMUNICATIONS YOU SEND TO THE OPERATOR; HUMAN ERRORS; TECHNICAL MALFUNCTIONS; FAILURES, INCLUDING PUBLIC UTILITY OR TELEPHONE OUTAGES; OMISSIONS, INTERRUPTIONS, LATENCY, DELETIONS OR DEFECTS OF ANY DEVICE OR NETWORK, PROVIDERS, OR SOFTWARE (INCLUDING, BUT NOT LIMITED TO, THOSE THAT DO NOT PERMIT ACCESS TO OR USE OF THE WALLET); ANY INJURY OR DAMAGE TO COMPUTER EQUIPMENT; INABILITY TO FULLY ACCESS THE WALLET WEBSITE, WALLET APP OR OTHERWISE, OR ANY OTHER WEBSITE OR APP; THEFT, TAMPERING, DESTRUCTION, OR UNAUTHORIZED ACCESS TO, IMAGES OR OTHER CONTENT OF ANY KIND; DATA THAT IS PROCESSED LATE OR INCORRECTLY OR IS INCOMPLETE OR LOST; TYPOGRAPHICAL, PRINTING OR OTHER ERRORS, OR ANY COMBINATION THEREOF; OR ANY OTHER MATTER RELATING TO THE WALLET WEBSITE, THE WALLET APPLICATION OR ANY OTHER ASPECT OF THE WALLET.

You assume full responsibility for any damages, losses, costs, or harm arising from Your Access and/or use of, or inability to access and/or use, the Wallet.

You FURTHER acknowledge and agree that the Operator have no control over, and no duty to take any action regarding (i) failures, disruptions, errors, or delays in the processing of Digital Assets that You may experience while using the Wallet, (ii) the risk of failure of hardware, software, and Internet connections, (iii) the risk of malicious software being introduced or found in the software underlying the Wallet, (iv) the risk that TPSPs may obtain unauthorized access to information stored within Your Personal Wallet, including, but not limited to Your Personal Wallet address, Private Key, and Seed Phrase, (v) the risk of unknown vulnerabilities in or unanticipated changes to the Blockchains SUPPORTED BY THE WALLET.

IN ADDITION, You hereby release the Operator from all liability related to any losses, damages, or claims arising from any and all (i) user errors such as forgotten / lost / misplaced Credentials, incorrectly constructed Transactions, or mistyped wallet addresses, (ii) server failure or data loss, (iii) unauthorized access to the Wallet application by malicious parties; (iv) bugs or other errors in the Wallet software, and (v) any unauthorized TPSP activities, including, but not limited to, the use of viruses, phishing, brute forcing, or other means of attack against the Wallet.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THUS THE ABOVE LIMITATION MAY NOT APPLY TO YOU. IN NO EVENT SHALL OUR LIABILITY TO YOU FOR ALL DAMAGES (OTHER THAN MAY BE REQUIRED BY APPLICABLE LAW IN CASES INVOLVING PERSONAL INJURY) EXCEED THE AMOUNT OF ONE HUNDRED U.S. DOLLARS ($USD100.00) OR ITS EQUIVALENT IN THE LOCAL CURRENCY OF THE APPLICABLE JURISDICTION.

THE OPERATOR IS NOT RESPONSIBLE, UNDER ANY CIRCUMSTANCES, FOR THE ACTIONS OR INACTIONS OF USERS AND THIRD PARTIES AND FOR FORCE MAJEURE CIRCUMSTANCES THAT CAUSED MORAL AND/OR MATERIAL HARM, AS WELL AS HARM TO LIFE AND HEALTH, REGARDLESS OF WHETHER THE OPERATOR COULD FORESEE THE POSSIBILITY OF SUCH HARM AND THE POSSIBILITY OF ITS ELIMINATION OR NOT.

THE OPERATOR,ITS SHAREHOLDERS, SUBSIDIARIES, AFFILIATES, LICENSORS, WEBSITE AND HOSTING SERVICES PROVIDERS, CONTENT PROVIDERS, EMPLOYEES, OFFICERS, DIRECTORS, AND AGENTSMAY NOT BE INVOLVED AS A PARTY IN DISPUTES BETWEEN USERS AND THIRD PARTIES, AND IN DISPUTES BETWEEN USERS AND PUBLIC AUTHORITIES, INCLUDING LAW ENFORCEMENT AUTHORITIES.

FORCE MAJEURE EVENTS

The Operator may not and shall not be held liable for any delays, failure in performance, or interruptions of service ORANY FAILURE TO FULFILL ANY OF ITS RIGHTS OR OBLIGATIONS UNDER THESE TERMS OF SERVICEwhich result directly or indirectly from any cause or condition beyond the Operator’s reasonable control, including but not limited to: any delay or failure due to any acts of God, acts of civil or military authorities, acts of terrorism, civil or industrial disturbances, blockages, embargoes, war, strikes or other labor disputes, fire, earthquakes, storms or other nature-related events, interruption in electrical telecommunications or Internet services or network provider services, failure of hardware equipment and/or software or other utility failures, smart contract bugs or weaknesses, technological changes, changes in interest rates or other monetary conditions, and, for the avoidance of doubt, changes to any Blockchain-related protocol, other catastrophe, or any other occurrences which are beyond the Operator’s reasonable control, INCLUDING BUT NOT LIMITED TOEVENTS SEVERELY IMPACTING THE DIGITAL / CRYPTO / VIRTUAL ASSET MARKET, SUCH AS BANKRUPTCY OF MAJOR SERVICE PROVIDES SUCH AS CRYPTO EXCHANGES, DEVALUATION OF PARTICULAR CRYPTOCURRENCIES DUE TO TECHNICAL ERRORS, HACKS, OR OPERATIONAL MISTAKES, AND OTHER SIMILAR EVENTS SEVERELY AFFECTING THE DIGITAL / CRYPTO / VIRTUAL ASSET MARKET.

WAIVER OF CLAIMS

By ACCESSING AND using thE Wallet and accepting the terms and conditions of these Terms of Service, to the maximum extent available under any applicable law You hereby waive, AND AGREE TO RELEASE AND HOLD HARMLESS THE OPERATOR, ITS SUBSIDIARIES, AFFILIATES, LICENSORS, WEBSITE AND HOSTING SERVICES PROVIDERS, CONTENT PROVIDERS, EMPLOYEES, OFFICERS, DIRECTORS, AND AGENTS AND ANY OTHER APPROPRIATE PARTY FROM, ANY AND ALL CLAIMS RESULTING FROM ANY ACTION TAKEN BY THE OPERATOR, ITS SUBSIDIARIES, AFFILIATES, LICENSORS, WEBSITE PROVIDERS, CONTENT PROVIDERS, EMPLOYEES, OFFICERS, DIRECTORS, OR AGENTS AND ANY OTHER APPROPRIATE PARTY DURING OR AS A RESULT OF INVESTIGATIONS WITH RESPECT TO YOUR ACCESS AND USE OF THE WALLET OR ANY PART, FUNCTIONALITY OR PORTION THEREOF, AND FROM ANY AND ALL ACTIONS TAKEN AS A RESULT OF SUCH INVESTIGATIONS BY THE OPERATOR, ITS SUBSIDIARIES, AFFILIATES, LICENSORS, WEBSITE PROVIDERS, CONTENT PROVIDERS, EMPLOYEES, OFFICERS, DIRECTORS, OR AGENTS, AND ANY OTHER APPROPRIATE PARTY, INCLUDING BUT NOT LIMITED TO ANY LAW ENFORCEMENT AUTHORITIES.

INTELLECTUAL PROPERTY RIGHTS

All rights, title and interests, including but not limited to the exclusive copyrights and other intellectual property rights in and to the Wallet and all parts, elements, functionality and components thereof including without limitation any and all computer code, technology, software engine, themes, objects, logos, artwork, menu items, user interface, embedded services, functionality, design of the Wallet, message exchange system, text, illustrations, photographs, graphics, audio files, video files, audio-visual files, names of goods, services, or online services, trade names, slogans, trademarks, service marks, other designations, as well as other materials and content available in or via the Wallet are owned by the Operator and/or its licensors and/or its subsidiaries and affiliates and/or third parties, constitute intellectual property of said parties, and the Operator and its licensors and such third parties retain all right, title, and interest in and to these intellectual property items. All contents of the Wallet, including the selection, arrangement, and look and feel, are protected by various national copyright, trademark and trade secret laws and by international treaties and conventions. Unless expressly provided otherwise in these Terms of Service no right, title, license or other interest in any of the contents or any patent, trademark, copyright or other intellectual property rights are transferred, assigned, licensed or otherwise conveyed to you by your access to and use of the Wallet hereby, and the Operator, or the party that provided the relevant intellectual property, at all times retains all right, title, and interest in any such intellectual property that You may be accessing or using when You access and use the Wallet.

All trade names, slogans, trademarks, service marks, designs and other designations used or mentioned in the Wallet are used solely for informational purposes, that is, to identify the relevant products, goods and services introduced into circulation by their right holders. The use of these designations shall not be deemed as explicit or implied endorsement by the Operator of their respective owners or their activities.

By accepting these Terms of Service You expressly agree that You are expressly prohibited to, and are prohibited to allow any third party to, perform any of the following actions, and any actions similar in nature or intent thereto, or actions that might be potentially regarded as violating any applicable laws, foreign or international law, including intellectual property and copyright law, and that performance of any such actions shall constitute a material breach of these Terms of Service:

·copy, replicate, distribute, modify, remake, republish, download, post, display, perform, add to, abridge, compile, adapt, translate, derive source code from, disassemble, decompile, reverse-engineer,or otherwise seek to obtain or derive the source code, including images and texts, underlying ideas, algorithms, file formats or non-public APIs from the Walletor create derivative works based on the Wallet or any part or portion thereof, update, broadcast, make available to the general public, or otherwise transmit, disseminate or use in any similar way or manner whatsoever the Wallet, any of its functionality, or any of the Wallet’s contents;

·sell or re-sell, license, grant on a royalty-free basis or transfer access to the Wallet or Your Personal Account in the Wallet;

·develop, distribute or host any interactive service, website or software application that is based on, or is confusingly similar to, the Wallet;

·remove, obscure or alter any copyright, trademark, or other proprietary notice appearing in any part or component of the Wallet or in its contents;

·use the Wallet for any benefit of any third party, commercial, non-commercial, or otherwise;

·incorporate the Wallet into a product or service You provide to third parties without Operator’s prior written consent;

·circumvent Wallet technology intended to limit Your access to or use of the Wallet;

·use the Wallet for competitive analysis;

·use the Wallet as part of any software, service, platform or project of any kind or to build competitive products;

·perform any other actions that may infringe or put under threat of infringement intellectual property rights of the Operator, its licensors or third parties with respect to the Wallet.

Notwithstanding anything to the contrary herein, Users shall not be restricted from reproducing or using materials, information and content owned by the Wallet Operator or its affiliates and available in or via the Wallet if that constitutes fair use (free use) under applicable law or otherwise not be prohibited under applicable Law, including use for personal or household purposes, or quotation for nonprofit educational, scientific, comment, illustration, explanation, example or criticism purposes. Such use shall be always accompanied with an indication of authorship and original source.

You understand and agree that You have no legal interest, monetary or otherwise, in any feature, functionality or content contained in theWallet or otherwise relating to it.

The Wallet may contain certain code, commonly referred to as `open source software`, which is distributed under open source license terms, including terms which allow the free distribution and modification of the relevant software’s source code and/or which require all distributors to make such source code freely available upon request, including any contributions or modifications made by such distributor (Open Source Software). To the extent that the Wallet contains any Open Source Software, that element only is licensed to You under the relevant license terms of the applicable third party licensor (Open Source License) and not under these Terms of Service, and You accept and agree to be bound by the terms and conditions of any such Open Source License.

You hereby expressly agree that the Operator, its licensors and relevant third parties are entitled to enforce their intellectual property rights with respect of the Wallet to the fullest extent of any applicable law in case of any violation of their intellectual property rights by You, including by means of administrative, civil-law, and criminal prosecution.

INDEMNITY

You agree to defend, indemnify and hold the Operator, its subsidiaries, affiliates, licensors, content providers, website and hosting services providers, employees, officers, directors, agents, representatives, licensees, authorized designees, successors, assigns and contractors harmless from and against, and reimburse to the Operator or any such party in full any costs or expenses arising or resulting from, any and all third party claims and all liabilities, assessments, actions, causes of action (regardless of the form), losses, damages, awards, judgments, fines, costs, expenses, and attorneys’ fees resulting from or arising out of:

·any breach by You of these Terms of Service, including but not limited to any breach of any provision of the Restrictions andIntellectual Property Rights Sections hereof;

·Your infringement or violation of any intellectual property, other rights or privacy of a third party, including but not limited to other Users of the Wallet; and

·misuse of the Wallet by a third party where such misuse was made possible due to Your failure to take reasonable measures to protect Your Credentials used to access your Personal Account and Personal Wallet Address in the Wallet against misuse.

The Operator reserves the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by You, in which event You will cooperate with the Operator in asserting any available legal defense mechanisms. This provision shall remain in full force and effect notwithstanding any termination of Your use of the Wallet.

JURISDICTIONS

The Wallet, its functionality and its contents are intended to comply with applicable laws and regulations of the Operator jurisdiction. Other countries may have laws, regulatory requirements and business practices that differ from those established in Operator jurisdiction. The Wallet may link to other apps and/or websites produced and/or operated by the Operator’s operating divisions and subsidiaries, some of which are located or hosted or intended to be accessed and used outside Operator jurisdiction. Such apps and websites may contain information and content that is appropriate only to that particular originating country.

The Operator reserves the right to limit access to and the ability to use the Wallet to any person, geographic region or jurisdiction. Any offer for any product, Wallet functionality, or other platforms and apps of the Operator, its subsidiaries and affiliates or third parties made via the Wallet or Your Personal Account therein is void where prohibited.

APPLICABLE LAW

These Terms of Service are governed by and shall be construed in accordance with the laws of the Operator jurisdiction without regard to its conflict of law provisions.

BINDING ARBITRATION AND WAIVER OF CLASS ACTION

Any and all differences, disagreements, claims, controversies and disputes of any nature whatsoever arising out of or relating to these Terms of Service, including any dispute relating to their validity, interpretation, performance or termination, shall be finally settled under the Rules for Expedited Arbitration of the Arbitration Institute of the Stockholm Chamber of Commerce and You (i) irrevocably consent to the venue thereinand (ii) hereby waive any objection based on lack of personal jurisdiction, place of residence, improper venue, orforum non conveniens in any such action. The seat of arbitration shall be Stockholm, Sweden. The language to be used in the arbitral proceedings shall be English. The number of arbiters shall be (Three) arbitrators. The arbitrators appointed in connection herewith shall be knowledgeable in laws governing these Terms of Service and crypto economy matters. The arbitrators must also be fluent in the English language. All submissions and awards in relation to arbitration under this Agreement shall be made in English, and all arbitration proceedings and all pleadings shall be in English. Witnesses not fluent in English may give evidence in their native language (with appropriate translation). Original documents in a language other than English shall be submitted as evidence in English translation accompanied by the original or true copy thereof. The procedural rules governing arbitration hereunder shall be established by the arbitrators; provided that (i) each party may call upon the other party to supply the arbitrators with documents in such other party`s control relevant to the dispute; (ii) each party shall be entitled to present the oral testimony of witnesses as to fact and expert witnesses; (iii) each party shall be entitled to question directly any witnesses who present testimony to the arbitrators and (iv) at the request of any party, a written transcript in English shall be made of each hearing before the arbitrators and shall be furnished to the parties. The arbitrators may, at the request of any party, order provisional or conservatory measures; provided that to the extent necessary to prevent irreparable damage any party may petition any court of competent jurisdiction for a preliminary injunction, temporary restraining order or other interim equitable relief pending the appointment of the arbitrators in accordance with this Section and action by the arbitrators upon any request for provisional or conservatory measures. Each party participating in such arbitration shall pay its own legal fees and expenses incurred in connection with the arbitration and the expense of any witness produced by it. The cost of any stenographic record and all transcripts thereof shall be pro-rated equally among all parties ordering copies and shall be paid by the parties directly to the reporting agency. All other expenses of the arbitration, including required traveling and other expenses and fees of the arbitrators and the expenses of any witness or the cost of any proof produced at the request of the arbitrators, shall be borne as determined by the arbitrators. Any award shall be final and not subject to appeal and the parties waive all rights to challenge any award of the arbitrators under this Section. Any award may be entered or presented by any of the parties for enforcement in any court of competent jurisdiction and the parties hereby consent to the jurisdiction of such court solely for purposes of enforcement of any award. You further agree that service of any process, summons, notice or document in the manner provided for notices in these Terms of Service shall be effective service for purposes of any such enforcement action. The prevailing party in any action or proceedingto enforce these Terms of Service shall be entitled to costs and attorneys’ fees.

You and the Operator agree to not commence against the other any class action, class arbitration or representative action or proceeding.

INJUNCTIVE RELIEF

You expressly acknowledge and agree that the Operator may suffer irreparable damage if You breach any of the provisions of these Terms of Service. Therefore, notwithstanding provisions of theBinding Arbitration and Waiver of Class Action section of these Terms of Service, in any case of Your violation of these Terms of Service the Operator shall be entitled to apply for injunctive relief and/or a decree for specific performance and such other and further relief as may be appropriate in any jurisdiction.

NO WAIVER

The failure of the Operator to exercise or enforce or delay in exercising or enforcing any right, power, provision or privilege under these Terms of Service shall not constitute or operate as a waiver, nor shall any single or partial exercise of any right, power, or privilege preclude any other or further exercise thereof. The waiver of any such right or provision will be effective only if in writing and signed by a duly authorized representative of the Operator. Except as expressly set forth in these Terms of Service, the exercise by either party of any of its remedies under these Terms of Service will be without prejudice to its other remedies under these Terms of Service or otherwise.

No waiver of any default, condition or breach of these Terms of Service shall constitute a waiver of any other default, condition or breach of these Terms of Service, whether of a similar nature or otherwise.

TIME LIMITATION ON CLAIMS

To the maximum extent allowed under any applicable laws You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to Your access to and/or use of the Wallet or these Terms of Service must be filed by You within (One) year after any such claim or cause of action arose or be forever barred. This provision shall remain in full force and effect notwithstanding any termination of Your use of the Wallet.

SEVERABILITY

If any part of these Terms of Service is determined by a court of competent jurisdiction to beunlawful, invalid, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms of Service and shall not affect the validity and enforceability of any remaining provisions of these Terms of Service.

CHANGES TO TERMS OF SERVICE

CHANGE OF OWNERSHIP

You will be deemed to have consented to the disclosure to, and use by, a subsequent owner or operator of the Wallet, of any and all information about You, including Your registration details, history of Your use of the Wallet and personal data (if applicable), contained in the applicable database used by the Wallet, to the extent the Operator assigns its rights and obligations regarding such information in connection with a merger, acquisition, or sale of all or some of the Operator`s assets, or in connection with a merger, acquisition or sale of all or some assets related to the Wallet, to a subsequent owner or operator.

In the event of such a merger, acquisition or sale Your continued use of the Wallet signifies Your agreement to be bound by the terms of service and privacypolicyof the Wallet`s subsequent owner or operator. This provision shall remain in full force and effect notwithstanding any termination of Your use of the Wallet.

MISCELLANEOUS

The terms and conditions set forth in these Terms of Service are fundamental elements of the basis of the agreement between the Operator and You with respect to Your use of the Wallet, and You expressly acknowledge and agree that the Operator would not be able to provide the Wallet and its functionality to You without the limitations and restrictions set forth herein.

The provisions of these Terms of Service that are intended to or by their nature should survive termination of Your use of the Wallet shall remain valid and shall be legally effective after any such termination.

You expressly agree that for the purposes of these Terms of Service You are not considered, and shall not represent Yourself as, an agent, employee, contractor, joint venturer, or partner of the Operator, and that Your use of the Wallet does not vest in the Operator or You the rights or obligations of the discussed entities and the Operator does not assume, by virtue of contract or law, liability for Your actions as for its own. You further agree that the Operator is not a party to legal relations that may be established between You and other Users for any reason and for any purpose, does not act or be deemed acting as an agent, guarantor, broker or representative, and is not responsible for such parties’ compliance with and adherence to their rights and obligations arising in connection with such legal relations.

You may not assign Your rights and obligations under these Terms of Service in whole or in part to any third party, and any attempted assignment in violation of this provision shall be null and void. The Operator may assign these Terms of Service or any of its rights and obligations under these Terms of Service without Your consent at any time, at its sole and exclusive discretion, with or without notice to you.

You must individually supply all necessary facilities, utilities and equipment necessary to access and use the Wallet, including but not limited to appropriate computer and/or mobile equipment and Internet connections, at Your sole risk and expense.

Use of the Wallet may or will involve transmission of data through Your Internet or mobile services provider’s networks. Your Internet or mobile services provider may charge You for such data transmission services. You may also incur additional third-party fees in connection with Your use of the Wallet. The Operator does not assume or carry any liability for Your payment of any such charges to third parties.

These Terms of Service constitute the entire agreement between You and the Operator relating to the subject matter hereof. Notwithstanding the foregoing, any additional terms and conditions expressly contained in or made available via the Wallet or its website at any moment will govern the products, functionality, services or Your relationship with the Operator to which they pertain.

Any notices or other communications provided by the Operator under these Terms, including those regarding modifications to it will be given by posting to the Wallet and/or through other electronic communication. You expressly agree and consent to receive electronically all communications, agreements, documents, notices and disclosures that the Operator provides or may provide in connection with Your Personal Account and Your use of the Wallet.
